May 25, 2020 OLA Press Release on Ban of Firearms by Order in Council

The following is a Press Release from the Ontario Landowners Association whereby we are supporting a Judicial Review against the banning of certain firearms that was recently passed as an Order-In-Council from the Trudeau Government.

We view this as an attack against Private Property.

These firearms are lawful and approved under the Criminal Code of Canada.  In their haste to remove firearms from the people, it appears this government did not read the Criminal Code of Canada that allows these firearms because they are used for a specific purpose (hunting or sports shooting).  Many of these firearms are the “Private Property” belonging to individuals who were required to pay and take a safety course on the handling of these firearms; they are required to show PROOF that they have the legal authority (approved by the RCMP) to purchase a firearm; they are required to apply and pay for a license to operate these firearms and they are required to follow all the appropriate regulations that apply to the use of firearms.

This is removal of Private Property being taken away from law-abiding citizens that respect the law…… but it just doesn’t stop there.  It also means the shutting down of many businesses, another hit against tourism – revenue that brings in billions of dollars.  This Press Release below explains the purpose of this Judicial Review.  The OLA have been approached by a Toronto lawyer who is representing some individuals in Ontario and across Canada asking for our support in promoting this project because it does represent another form in the removal of Private Property from the people.  What will they take from us next?

OLA Press Release:

On May 1, 2020, Prime Minister Justin Trudeau, using an “Order-in-Council”, passed Regulation

SOR/2020-96, formally known as, Regulations Amending the Regulations Prescribing Certain Firearms and Other Weapons, Components and Parts of Weapons, Accessories, Cartridge Magazines, Ammunition and Projectiles as Prohibited, Restricted or Non-Restricted.

This Regulation prohibits the purchase, sale, transport, import and use of approximately 1,500 models, types, variants, or modified versions of firearms that were previously classified as restricted or non restricted. Included in this Regulation are firearms that are used for the lawful purpose of sport shooting and hunting.

This is contrary to the statements made by the Trudeau government that these firearms were identified as “military-style” and “assault-style” weapons. Shotguns and rifles used for generations to hunt duck, deer, moose, and other game are now banned and prohibited firearms.

This specific Order-in-Council removed the right of Parliamentary debate, committee review and the democratic process for passing legislation to create law. Most importantly, it removed our right as Canadian citizens, to know, question and voice our opinion to what our government is doing.

The Trudeau government, using the COVID-19 health crisis, removed our right as Canadian citizens to have our voice heard. Our elected MPs are the voice of the people and they were prohibited from debating this important matter in Parliament.

The financial repercussions of this Order are a staggering loss in Billions of dollars. Employment layoffs will be in the thousands. Manufactures of firearms, ammunition, clothing, hunting, camping gear, ATV’s, hunt camps, recreation, boating, outfitters, distributors, and retail will be directly affected. Canadians do not need more financial hardship. Within 2 years, Canadians who own hunting and sport firearms will have their private property confiscated by government agents or face criminal charges for possessing prohibited weapons.

This specific Order-in-Council, signed by Justin Trudeau, has removed our democratic rights as Canadian citizens and violated Section 117.15(2) of the Canadian Criminal Code that states an Order-in-Council may only be used to ban firearms that are not “reasonable for use in Canada for hunting or sporting purposes”. This Order-in-Council is inconsistent with the provisions of the Criminal Code and therefore invalid.

Arkadi Bouchelev, Barrister and Solicitor in Toronto, is representing several individuals, to bring a challenge before the Federal court asking that Regulation SOR/2020-96 be overturned. The Regulation was created without consultation with a multitude of individuals, businesses, and non-profit organizations such as gun clubs and sporting leagues.

The Ontario Landowners Association has taken a position on this Regulation. We view this as not a firearms issue specifically, but as a direct attack on the lawful ownership of Private Property. The removal of lawfully purchased Private Property without compensation and the removal of hunting and sport shooting established over hundreds of years as part of our culture and heritage.

The Ontario Landowners Association supports this legal challenge and we ask that you contribute to the legal fund that will be established to pay for the cost of this challenge.
