OSPCA Act Appeal Hearing – October 1, 2019

We’re almost there!

You may recall that we filed a Notice of Application starting a Charter Challenge of the OSPCA Act in October 2013.

This resulted in a five and a half-year process that produced a favourable decision for us, in January 2019.

But, not so fast! The Attorney General of Ontario appealed the decision in February 2019. She probably felt she had too. This decision, after all, is precedent setting. The court found that “the government was wrong to grant police powers to the Ontario Society for the Prevention of Cruelty to Animals without also imposing accountability and transparency standards on the agency.

The Attorney General has filed the notice of appeal on several grounds, including one arguing the court erred when it recognized a new principle of fundamental justice that law enforcement bodies must be subject to reasonable standards of transparency and accountability.”

The date set for the appeal hearing is Tuesday, October 1st, 2019 at 10 AM at the court of Appeal for Ontario, 130 Queen Street West, Toronto.
